Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Scriptly AI platform ("Service") provided by Castillo Marketplace LLC ("Company," "we," or "us"). By using the Service, you agree to these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using Scriptly AI, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

2. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use.

3. Subscription and Billing

Scriptly AI offers Free, Pro, and Enterprise subscription plans. Pro and Enterprise plans are billed on a recurring monthly or annual basis. By subscribing, you authorize us to charge your payment method.

• All fees are exclusive of taxes unless stated otherwise.
• Subscriptions auto-renew until cancelled.
• Cancellations take effect at the end of the current billing cycle.
• Refunds are governed by our Refund & Cancellation Policy.

4. Acceptable Use

You agree not to use the Service to:

• Generate illegal, harmful, fraudulent, or deceptive content
• Infringe on intellectual property rights of others
• Distribute malware, spam, or unsolicited communications
• Attempt to reverse engineer, scrape, or abuse the platform
• Violate any applicable laws or regulations

5. Intellectual Property

You retain full ownership of all content you generate using Scriptly AI. We claim no rights over your outputs. The Scriptly AI platform, including software, designs, and branding, is the intellectual property of Castillo Marketplace LLC.

6. Termination

We reserve the right to suspend or terminate your account for violation of these Terms. You may cancel your subscription at any time from your Billing dashboard. Upon termination, your access to paid features ceases, but your content remains exportable for 30 days.

7. Limitation of Liability

To the maximum extent permitted by law, Castillo Marketplace LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

8. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Orange County, California.
